I am directed by Lord Moyne to transmit to you, to be laid before the Lords Commissioners of the Treasury, a copy of a letter with enclosure from The British North Borneo Company regarding certain claims against the Hong Kong Government in respect of firewood purchases made on its behalf in North Borneo before the outbreak of war with Japan.
ENCLOSURES
2. Lord Moyne is of opinion that while a case may exist for the re-payment to the North Borneo State Bank of the amount which it has actually paid out as Agent of the Hong Kong Government for firewood purchases, no other payment to the Bank could be held to be justified in the present circumstances.
FURTHER ACTION In view of the imminent likelihood of the
territory being completely in enemy occupation, there seems to be little point in considering the question of payments to local firewood Companies, but as regards the North Borneo Trading Company, whose headquarters are in London, they could not, in any case, expect to receive payment by Government for any thing in respect of which they had not themselves made payments to the legal suppliers of firewood. It is understood that it is unlikely that the Company would be in a position to show that they had, in fact, made any such payments.
